Can I sue the Sheriff’s department for their officers behavior? ?

Yesterday my son was brought home by two officers. The officers were arrogant, condescending, harassing, threatening along with many other words I could come up with. My son was out with a friends BB gun that he bought from him for 4 dollars. My son is 11 years old and even though BB guns are legal I wouldn’t buy him one because the kids in my neighborhood actually shoot at each other with them. My son was going down to the creek to shoot at the sand piles. On the way there (in the neighborhood, which is upper class) he stopped and for some dumb reason pointed the gun at someones house. Remember, he is 11. BB guns are legal to own. He did not know he upset the owners and he doesn’t know who lives there. The owners of the house called the police on him. He was there for a few minutes and then continued to the creek. On his way back from the creek the officers brought him home to our house. The officers told me that he had pointed the gun at the house. I said to my son “so that is what you did with that 4 dollars”. I said to my son “what the hell were you doing pointing the gun at someones house?” he said he was practicing his aim. He definately wasnt doing it maliciously. I told the police that my son wasn’t allowed to have a BB gun and I was trying to tell them how the other rich brats in the neighborhood act and my son just wants to fit in. The police said I was defending my son. I said to them more than 3 times that he was definately going to be punished because he went against me and bought the BB gun from the 8 year old around the block. We are talking about a plastic BB gun which is legal. I agreed that it was stupid for him to point the gun at the house. The police were very condescending toward me, they threatened me 2x that I had to get a lawyer and they were taking me to court. My son didn’t commit a crime. One of the officers asked me what I thought would happen if he took it to school? I said “he isn’t that stupid”. Then I said “well of course he would get suspended”, the officer said NO EXPELLED. What the heck does that have to do with my son going down to the creek by himself and being stupid on the way and pointing the gun at the house? The whole thing was them throwing their weight around and putting me down. They said I was defending him and that is why they were going to take it to court. The whole thing is ridiculous. I was definately upset with my son and he is grounded. But because I did defend him because they were treating me and my son as if he had a 357 magnum in his hand I did defend him as well. The police accused me of lying when I told them that I would never buy him a BB gun because I dont want him involved with the kids in the neighborhood. I went around the block later to find out what happened with my neighbor. My neighbor told me that his son, who is 8 years old, told the police he sold the gun to my son for 4 dollars. The police told my neighbor that they would just “smash the BB gun”. This is wrong. It is not their property to destroy. It is mine and I want it back so I can return it to the neighbor and get the 4 dollars back or I will get rid of it myself. It is my property and it is LEGAL for my son to have it, even though I don’t want him to own one. These police, like alot that I have ever dealt with in Tennessee were nasty. I know that police are there to protect us and that is great but that doesnt give them the right to talk to me like I am a piece of crap and threaten me because they think I am defending my son. I am going down to the Sheriff dept today to get the BB gun back. If I don’t get the gun I am going to file a complaint. I am sick with fibromyalgia, chronic fatigue, MS and other illnesses.Any stress makes me sicker and this had me totally upset and shaking last night. Today I am in so much pain. If they continue to be “holier than thou” towards me I want to sue them for their ridiculous actions because it is uncalled for and has made me sicker. They have no right to verbally and mentally abuse me then destroy the BB gun when it isnt theirs and it is legal for my son to have one, is it?

You can’t compare the scenario of your real gun, to the BB Gun.

To CH? I can’t remember your exact initials. I live in a very safe subdivision, as I stated above, I would not allow my son to have a BB gun. He went behind my back and got one from a friend. I didn’t know he had it. I am not saying what he did wasn’t wrong, because it is. If you read my entire story, you will see where I stated I agree with the officers and that he is grounded. I do discipline my child and I agree that BB guns shouldnt be legal, but they are. I am a good parent. What I am upset with is the way the police think they can just verbally abuse anyone they want to because they are wearing a uniform. That is what I am upset about. Also, I probably wouldn’t sue but maybe these officers need to be talked to about how to treat people. Their uniforms don’t give them a right to verbally abuse.

To ! I am happy to see that you see where I am coming from. My son is in big trouble with me and today when i get the report from the Sheriff’s dept I am going to speak to the Captain. I plan on filing a complaint on the officers. I agree that suing probably isnt the first approach. I am just so upset over how they talked down to me and threatened me. I will see how I am treated today when I go down there and try to have a civil conversation. I dont have enough points to give a thumbs up. This is the second time I have used this thing to ask a question. I am glad there are at least a few people that can be objective and don’t want to blame me when they dont know me.

In Tennessee, you need to go to the sheriffs dept to get a copy of the police report. They dont fill one out for you in your driveway like they do in other states for car accidents or everything else. I went down there and spoke with the Captain, I told him the whole story before I even saw the report the officer wrote. Too make a long story short, the Captain was not happy that the officer took the BBgun to the dept without the complainant wanting to prosecute. He said that those 2 things go together. We had a great conversation and he thought they had nothing criminal to pursue. When I finally read the report as I was leaving I saw that the officer had outright, blatantly lied about what happened when he came to my home. I went back to the Captain and he told me not to worry that he already knows that the report wasnt filled out truthfully by my statement. He told me not to worry about it. End of Story. For now:)

To any: State Troopers, Sheriff Deputys, City Police Officers?

Im 19 and i have an undying passion to be in law enforcement. i wanna try and get as much advice from enforcement officers themselves so i can choose the right position for me. the problem is i cant decide at all! and i need to start applying for highway patrol in december and sheriff’s office and nearby cities in june. i have been on many ride alongs but i still don’t have any clear decisions. i was hopeing you could tell me what you experience in your position, wether it be state, county, or city. any advice would be appreciated too lol Thank you so much!!

Why does the Police Dept & local County Sheriffs dept look the other way, when their officers committ crimes?

Example: A Police officer gets stopped for drinking & driving, he always gets a lesser penalty if any at all. Why do we allow judges to dismiss or plea bargain these cases when they should be held accountable like anyone else breaking the same law?

more info this is a small town, where everyone knows everyone. My fiance was arrested on a fake warrant, (found out is was fake from a VERY reliable source) but the person who told the truth will not come forward and admit in a court. Who do I need to go to from here?

What do Sheriffs think about working with reserve officers?

I plan on taking my level 3 reserve class soon, and then level 2 that are offered at a local college. I was just wondering what officers think about having to work with reserve officers who may not have the same training? Do they get treated well, or are they looked at in a bad light? By the way thins is in Ca.

1. Suppose you are behind someone in your MARKED POLICE UNIT. Which do you notice occurs most of the time?

a) The driver in front of me does the posted speed limit exactly.
b) The driver in front of me drives 5MPH LESS of the actual post speed limit (i.e. if the speed limit is 30, they do about 25).
c) Other (please explain)

2. Now, suppose you are driving an unmarked Crown Victoria Police Interceptor behind someone. Which do you notice occurs most of the time?

a) The driver in front of me does the posted speed limit exactly.
b) The driver in front of me drives 5MPH LESS of the actual post speed limit (i.e. if the speed limit is 30, they do about 25).
c) The driver in front of me does not realize I am an unmarked unit.

3. As a police officer, do you feel you can catch more violators in an unmarked unit?

4. Suppose you are driving on the Interstate or a road that has two or more lanes (left lane being the fast lane, a middle lane and a right lane). Suppose you are in the far right lane, or the middle lane. When you are driving a MARKED POLICE UNIT, will other cars usually pass you in either the left lane or right lane even if they are just going 5 MPH over the posted speed limit (i.e. like 68 or 70 in a 65 MPH)?

5.) When you are driving a marked police car, have you ever had anyone tailgate you or follow you closely?

6.) This is my opinion. Please answer this if my thinking is wrong. Most cops on the highway usually drive in the fast lane and just pass all the cars. Sometimes they could be en route to an emergency. As a civilian, we don’t know. However, if you are cop on the highway, do you like to pass all the cars just to get by as many as you can? For example, if you are driving at the speed limit with all the other cars, all the cars might be freaked out or just scared to pass or do anything and some may just be nervous of making a violation. Do you like to get away from staying close to the same vehicle as much as possible when you are patrolling to make them less nervous of committing a violation?

I am asking these questions for curiosity purposes. It’s been a while since I have participated in a ride-along.

****POLICE OFFICERS ONLY**** please?

Is it legal for an Orange County Sheriff to pull you over in a city. rather than in his jurisdiction, the city i was pulled over in was in westminster, in my neighborhood, which is patrolled by the westminster police dept. and just across the Major intersection is Midway city. Ive never seen OCSD on the Westminster side pulling people over or responding to calls. then a westminster police officer drove by and the sheriff gave me my ID back and left, and the Westminster Police Officer asked me what happend and I explained to him and he said I can go.

Easy Questions for Current Officers/ Sheriff/ Troopers In Texas?

If your backing out of a parking spot and hit someone passing by behind you…who is at fault?

Is it ok to report someone parked in a handicapped spot with no handicapped parking plate hanging
&
Someone that makes there own space like park on the stripes or on the edge of a row of cars that is not a parking space and in the way of traffic in the parking lot?

Police Officers, Sheriff Deputies, Troopers, please answer this law traffic enforcement question?

Anyone is a police officer or has law enforcement experience; please answer this if you would.

In an online forum, where only police officers can post messages, one of the troopers stated that police officers can conduct traffic stops on vehicles whose car tires’ touch the yellow lines/paint in the road. He didn’t elaborate enough so there are a few questions I have about it. Assuming this is correct, here’s my question. What kind of traffic offense would you call this? There’s always a name of for something. When someone spits on a cop, he can charge them with “battery by body waste” or “assault”. I’m looking for the term that describes when a motor vehicle touches the yellow line. If I were a cop, I would suspect the driver is possibly under the influence of alcohol and stop him on suspicion of DUI. That would be my probable cause (PC). Am I partly correct that it would simply be DUI? Could it be “poor driving coordination” LOL, never heard that term before though.

I know swerving is a PC to stop someone which could be a possible DUI. So maybe that is the term.

Also, what is the difference between DUI and DWI?
DUI=Driving Under the Influence
DWI=Driving While under the Influence

I am taking a police civil service exam that is schedule this month. I’m trying to learn as much as I can at the same time I guess.

Can officers from one county execute a search warrant in another?

A friend in Tennessee lives near the county line, sheriffs officers of the neighboring county executed the search based on the warrant which was also issued in the next county. Members of the TBI were also present. Is this legal?
The officers weren’t there to arrest him for a previous crime, it was to search and see if he had marijuana for resale in his house, they had no positive proof he had done anything illegal. Why wouldn’t the county he lives in be the one that issued the warrant and sent officers to execute it? Is it normal for officers to go out of their jurisdiction like that?

Why do some police officers beat or kill unarmed citizens?

Example: Rodney King. Yes, the guy sped and was high on PCP, but at the point he stopped resisting they just kept beating him with nightsticks.

I have even heard of wheelchair bound inmates at Tent City (Maricopa County, stomping grounds of Sheriff Hoe-Boe-Joe) being tasered for lingering in the food line too long.

Why do police officers beat or kill unarmed civilians when they clearly know it is illegal and a violation of law, the same laws they are supposedly said to uphold?

Seriously, if you are a police officer and you see your comrade beating someone up unjustly, do you just laugh and go along with your chum, or do you actually act as a human being and defend the person being pummeled?

Are cops even human beings anymore, or are they just pre-programmed robots, oblivious to right and wrong?

Please tell me that the videos on that page do not constitute police brutality. Especially view Video #2 of the 2nd set when they beat down a man for argung with the cops about what they just did to another man (in fact, all of the people coming out of their homes were outraged at the cops, and rightfully so).
