Homeland Security Secretary Janet Napolitano stunned many listeners during an appearance on CNN when she asserted that illegal immigration is really not a crime.

In an interview with CNN’s John King last week, Napolitano discussed Sheriff Joe Arpaio of Maricopa County, Ariz., a strict enforcer of immigration laws who says he wants illegal aliens to be prosecuted and jailed.

King said: “A lot of Democrats in Congress want you to investigate him. They think he is over the line. He says he is just enforcing the law and the problem is the federal government.”

Napolitano responded: “Sheriff Joe … knows that there aren’t enough law enforcement officers, courtrooms or jail cells in the world to do what he is saying.

“What we have to do is target the real evil-doers in this business, the employers who consistently hire illegal labor, the human traffickers who are exploiting human misery.

“And yes, when we find illegal workers, yes, appropriate action, some of which is criminal, most of that is civil, because crossing the border is not a crime per se. It is civil. But anyway, going after those as well.”

The fact is, crossing the border without authorization is a crime. The statute reads: “Any alien who enters or attempts to enter the United States at any time or place other than as designated by immigration officers . . . shall, for the first commission of any such offense, be fined under title 18 or imprisoned not more than 6 months, or both.”

“The suspect came armed with the firearm and shot her multiple times, and then, we believe, he turned the gun on himself and shot himself,” Orange County Sheriff’s Department.

I just read this article, and its pretty sad. Maybe if the US banned all guns for civilian use, a long time ago, these kind of things wont happen. Not to mention they spill into Canada. Europe doesn’t have them.
If he came with a knife, her chances of Survival would be much much higher.
So every person needs to have a gun, even when they’re at work….hmm that sounds very smart.

Firearm laws in Palatine, IL?

I am thinking of buying a handgun for target shooting and I wonder if there are any local Palatine or Cook County laws/regulations in addition to the state code. Do I have to register the gun with the Sheriff’s Office or anything like that?

I tried to search the web, but Palatine PD don’t seem to have a website and the Sheriff’s has no mentioning about firearms.

Compare and contrast: Arizona’s new immigration law -vs- Vagrancy laws in the South 100 years ago?

“On March 30, 1908, Green Cottenham was arrested by the sheriff of Shelby County, Alabama, and charged with “vagrancy.” Cottenham had committed no true crime. Vagrancy, the offense of a person not being able to prove at a given moment that he or she is employed, was a new and flimsy concoction dredged up from legal obscurity at the end of the nineteenth century by the state legislatures of Alabama and other southern states. It was capriciously enforced by local sheriffs and constables, adjudicated by mayors and notaries public, recorded haphazardly or not at all in court records, and, most tellingly in a time of massive unemployment among all southern men, was reserved almost exclusively for black men. Cottenham’s offense was blackness.

After three days behind bars, twenty-two-year-old Cottenham was found guilty in a swift appearance before the county judge and immediately sentenced to a thirty-day term of hard labor. Unable to pay the array of fees assessed on every prisoner—fees to the sheriff, the deputy, the court clerk, the witnesses—Cotte’ham’s sentence was extended to nearly a year of hard labor.

The next day, Cottenham, the youngest of nine children born to former slaves in an adjoining county, was sold. Under a standing arrangement between the county and a vast subsidiary of the industrial titan of the North—U.S. Steel Corporation—the sheriff turned the young man over to the company for the duration of his sentence. In return, the subsidiary, Tennessee Coal, Iron & Railroad Company, gave the county $12 a month to pay off Cotte’ham’s fine and fees. What the com’any’s managers did with Cottenham, and thousands of other black men they purchased from sheriffs across Alabama, was entirely up to them…”

The national outcry over Arizona’s immigration law is nothing new for Prince William County residents — hundreds ofpeople on both sides of the illegal immigration debate poured into marathon public hearings in fall 2007 when the county was passing its crackdown.

Since then, the county has turned over more than 2,000 suspected illegal immigrants to the federal government, and crime last year reached a 15-year low.

Other Northern Virginia jurisdictions also have turned over hundreds of suspected illegal immigrants to Immigration and Customs Enforcement through their own programs.

But law enforcement officials remain wary about their new roles enforcing federal law, and immigration experts and immigrant advocates warn that such steps can have negative consequences, such as racial profiling and a loss of trust with local police
Implementing Prince William’s crackdown involved drafting a legally soundpolicy and training hundreds of officers, as well as conducting a significant community outreach program with more than 300 meetings, said Deputy Police Chief Barry Barnard.

“It was a new role for us,” he said. “Traditionally, local law enforcement doesn’t enforce immigration laws.”

The county partnered with the federal government under the 287(g) program, which allows local law enforcement officials to enforce certain immigration laws.

Prince William’s original proposal was so sweeping that it asked county officials if it would be possible to keep illegal immigrants off county roads and away from the county Web site.

County supervisors scaled back the measure, voting in October 2007 to direct police officers to check the residency status of crime suspects if they had probable cause to believe they were in the country illegally.

In 2008, the policy was changed to require officers to check the status of everyone arrested. Officers then had to be retrained, Barnard said.

Loudoun also participates in 287(g), as well as the federal Secure Communities program, which Sheriff Stephen O. Simspon said he prefers because it runs fingerprints of everyone arrested through biometric immigration records held by the Department of Homeland Security and FBI criminal records

Eviction Laws in Delaware County PA?

We are looking to purchase a home that was forclosed on over 90 days ago. A family friend, that would like to sell us this house, is now the new owner and has been issued the deed. I think the eviction process has to start now, but I am unclear as to how long this will take and what rights the guy who was foreclosed on has now. We were hoping to move sometime in the Fall (the house went to sheriff sale in April), but this seems to be dragging on forever and we may need to move on from this potential deal. I can’t seem to find any information specific to this part of the forclosure process. Any advice?

Why do people hate the Sheriff of Maricopa Co. for enforcing immigration laws?

Although, only the outspoken people are against it, the people who may suffer the consiquences of his upholding the law. The rest of the people support it because they support the laws being upheld. I’m not sure what percentage of either.

Is Joe Sheriff Arpaio doing a fine job of upholding the laws of America 127 illegals arrested past 30 days?

PHOENIX — Maricopa County Sheriff Office (MCSO) arrested 27 undocumented immigrants Tuesday night at four different traffic stops in a three-hour period, while working in the northwest part of the Valley.

In the past 30 days, sheriff’s deputies have arrested 127 undocumented immigrants.

Of those suspects, 106 of them were booked into the 4th Avenue Jail on felony charges.

To date, MCSO has arrested 1,396 immigrants on felony state and human smuggling charges.

Sheriff Joe Arpaio has vowed to continue enforcing all aspects of the state and federal immigration laws.

Does it make you wonder what other laws the mayors of these cities are “overlooking Arizona sheriff stirs?

GUADALUPE, Ariz. (AP) – The self-proclaimed “toughest sheriff in America” has been making forays into Phoenix and nearby Guadalupe and sweeping up illegal immigrants, drawing howls of protest from the cities’ mayors and other community leaders.

While Maricopa County Sheriff Joe Arpaio has legal authority to enforce the law in cities within his county, politicians and activists are accusing him of grandstanding and, worse, racial profiling.

A total of 150 people—73 of them illegal immigrants—were arrested by Arpaio’s deputies in the raids on heavily Hispanic sections in late March and early April.

“I was upset. We did not request them here,” said Guadalupe Mayor Rebecca Jimenez, who charged that the patrols were meant to raise Arpaio’s profile for his re-election campaign this year.

Guadalupe, a community of about 6,000 people that relies on the sheriff’s office for police protection, is taking steps to find another department to patrol its streets.

As for Phoenix, Mayor Phil Gordon said Arpaio should be concentrating on more pressing duties such as finding people with warrants against them, and he has asked for a federal civil rights investigation, complaining the sheriff is singling out people who are “driving with a broken taillight or have brown skin.” The U.S. Justice Department refused to comment. http://www.breitbart.com/article.php?id=D90922HG0&show_article=1&catnum=0
I’m amazed people are outraged over people being arrested for breaking the law. Wonders will never cease.

Deported illegal alien can you believe this sues the sheriff’ claims not his job to arrest him above the laws?

BUTLER COUNTY, Ohio — Butler County Sheriff Richard Jones faces charges in federal court that he violated a man’s constitutional rights. The court will decide if the sheriff authorized his employees to detain an illegal immigrant and whether that was his right to do.

Luis Rodriguez had lived in the United States for 11 years when Butler County Sheriff’s deputies and a former federal immigration worker Jones had hired at the sheriff’s office arrived at the construction work site where Rodriguez was working on Port Union Road in Hamilton in 2007.

Rodriguez’ lawyer, Al Gerhardstein, says the deputies and the former ICE agent said they wanted to talk to a supervisor about documenting workers. But while there, they also questioned several workers including Rodriguez. They arrested him and he was deported. His family, including two children born in the United States and therefore U.S. citizens, returned to Mexico so the family could remain intact.

Rodriguez sued the sheriff, saying it wasn’t his place to do the job of federal immigration agents.

Tuesday, at the federal courthouse in downtown Cincinnati, Judge Tim Black heard arguments from Gerhardstein that the sheriff’s workers had conducted an illegal detention and questioning. “Our case is not really about whether or not he should be sent out, ” Gerhardstein says. “Our case is about the process we use and the fairness we apply to people. In this case, we are arguing that the sheriff deputies illegally arrested him. Swept into a work site without using the common legal means. Didn’t have probable cause, didn’t have reasonable suspicion, and seized him and collected the evidence they needed to deport him.”

The sheriff’s attorney disagreed and told Judge Black that other courts have ruled in similar cases that what the sheriff did is legal.

Sheriff Jones wouldn’t comment on the case to the I-Team.

Judge Black will decide in the next few weeks if the case should go to trial, get a direct verdict from a jury or if he rules for the sheriff, he could throw out the case altogether.

Do you see any problems here All Arpaio’s deputies to get immigration training are we a nation of laws or not?

The Maricopa County Sheriff’s Office says it plans to train its entire force of 881 deputies in enforcing federal immigration law.

The announcement comes about four months after the federal government stripped 100 deputies in the office of their power to make federal immigration arrests.

Maricopa County Sheriff Joe Arpaio says the federal government’s rebuke won’t prevent his deputies from cracking down on illegal immigration and that federal law gives local police agencies the power to enforce federal immigration law without getting approvals from Washington.

Critics say officers racially profile Latinos in the patrols. Arpaio repeatedly denied the racial profiling allegations.

Three people in connection with the Thursday killing of a Border Patrol agent in San Diego County were arrested at O’Connor Hospital in San Jose Friday.

Border Agent Killing Strikes Nerve Among Immigrant Activists

The shooting of Agent Rosas is striking a nerve among Immigration Activists, who say his death is a result of failed border policies.
Agents with the Department of Homeland Security surrounded the hospital and arrested two men and one woman.

At least one suspect wanted for the murder of a U.S. Border Patrol agent was reportedly injured during the attack and may seek medical attention on either side of the U.S.-Mexico border, authorities said Friday. Authorities said they traced the cell phone of one of the people arrested.

Investigators checked hospitals and medical facilities in hopes of finding whoever shot and killed Agent Robert Wimer Rosas, 30, late Thursday, said Keith Slotter, special agent in charge with the FBI’s San Diego bureau.

Rosas spotted a suspicious group in the remote Campo area near the Mexican border Thursday night and called for backup, according to Border Patrol spokesman Daryl Reed. When the suspicious group split up, Rosas went after some suspects by himself. Other agents lost radio contact with him.

Around 9 p.m., the other agents heard gunshots and found the agent. Rosas was pronounced dead at the scene at about 9:15 p.m. on Shockey Truck Trail in Campo, Battalion Chief Nick Schuler said.

The San Diego County Sheriff’s Department said Rosas was shot in the head.

Rosas was 30-years-old and had served with the Border Patrol for the past three years. He is survived by his wife, 2-year-old son and 11-month-old daughter.

Rep. Darrell Issa issued a statement Friday about Rosa’s slaying.

“What happened last night was a tragedy and a painful acknowledgment that at any time, our Border Patrol agents may be put into an extraordinary circumstance,” Issa said. “The thoughts and prayers of our entire region are with the family and friends of this fallen agent.”

A search on both sides of the border after the killing failed to find anyone.
