My husband and our son currently live in a townhouse, and have lived here for about 7 months. It’s a smaller building, we are 1 of 4 units in the building. On Friday afternoon, someone came to our door serving us foreclosure papers, and letting us know the property will be up for sheriffs auction on December 3rd, however, we have 6 months to live at the property after the sheriffs auction. Being that the property is in foreclosure (and has been for several months, and we’ve also found out that the landlord has not been paying the mortgage at all, that everyone’s rent has been going directly into his pocket every month..) Are we still liable to pay him rent for the remaining months? He told us ‘whoever decides they don’t have to pay rent this month will be evicted’.. however, we also found that the company who wrote up our lease agreement is no longer in business. Does that make the lease null in void? There is absolutely nothing in our lease about foreclosure. I just want to know what our responsibilites and what not are in this situation. Thank you!

Is there any difference between purchasing a house from a bank vs. an individual?
I’m currently looking at a house that is owned by a bank. The house was foreclosed on and went to a sheriff’s auction where the bank purchased it back. Is there any differences between buying from a bank vs. buying a house from an individual?

Can I legally get back into my house during foreclosure?
I’m in the process of bankruptcy and we’re foreclosing on our house. We’ve moved out already, however, we still have some things I’d like to get out if I can. Problem is: there is a lockbox on the door, and it went up for a sheriff’s auction this past Friday (and it did sell). I am assuming that we’ve lost our stuff, but I thought I’d ask here anyway. This is in Ohio in case that matters.
If I filed for Bankruptcy can i get a home loan?
I filed for bankruptcy last Oct 05 husband did not and we want to purchase a house and land that is going up for Sheriff’s Auction. Will we be able to get a loan? And where should we go to get a loan?

Hi I need some help. I was served papers for my landlord who lives
upstairs, for a foreclosure back in Dec. we talked to her about it, and
she said that she is working it all out, and not to worry. I came home on
Wednesday the 22nd of Apr. and there was a huge Sheriffs Auctions Sale
notice posted to the front door.
I again went up and talked to her because I don’t want to be locked out of
my apartment or lose my belongings because of her mishap. She again told
me don’t worry about it that the mortgage company she is working with
tells her that everything is ok don’t worry about the notice. I looked it
up on the internet and it is posted for Auction.
I walked away feeling like she was lying to me because in her next breath
she said her husband would be home on Friday the 24th and not to say
anything to him about it. (hes been in boot camp since Jan.)
We spoke to her on Sunday and told her that we were looking for a new
apartment and she was like…”well, if that’s how you feel about it” and has been
ignoring us ever since. We have found a new apartment and are planning on
moving in May 15th. We ran into her husband and he asked what were we
doing spring cleaning, and we told him no that we are moving and planning
on doing it the 15th of May.
Needless to say she never said anything to him about us moving out.
Here is my issue she has a $400 deposit of mine, I don’t want to pay my
rent for May since my (month to month) lease is up on the 5th and we are moving on the 15th. I feel because she hasn’t been honest with us she is forcing us to
take on this financial burden of having to come up with more money for a new
deposit and 1st months rent…Which we really don’t have.
My plan is to let her keep the deposit of $400 and that will be the rent
for the 10 days we will be there.
So since she is avoiding us like the plague, and we don’t see her I have
to write a letter to her. I am not concerned about being put on the do
not rent list. I just don’t want to come home and have locks on the doors
and lose my belonging.

What happens to the money owed on a foreclosure after an auction failed to cover the amount owed?
I was looking at the Sheriffs sale and a lot of the houses are appraised for LESS than owed on the house. So shat happens when they don’t get enough to cover the loan, who pays the rest? Do the owners just do bankruptcy?
I came home today to see a foreclosure/public auction sign on my apartment….?
My stupid landlord didn’t pay the mortgage which I kind of assumed when the sheriff was here looking for him. So anyway the date of public auction is 10/27/07. I am going to start looking for an apartment tomorrow, but does anyone know how much time I will have to move and do I need to continue to pay rent?
I am 7 months pregnant and have an 8 year old son with special needs. Should I be looking for something right away or do I have until maybe November 1st?

If someone buys proprety from a sheriffs auction can they take the personal items on that property?
We had a boat and a few other items on that property and had no idea it was up for auction all we had was a verbal agrement with the owner (wich there property is next to ours) that we could use there big shed to store our boat and riding law mower there.
